Pennsylvania Recalled Toys AttorneysThe Pennsylvania legislature recently battled over a bill to protect the state’s children against the dangers of recalled toys. In May of 2008, the House unanimously passed a bill demanding that the toy retailers pull dangerous products from shelves within three days of notification. Retailers were also given a month to warn consumers who had recently bought any recalled products from their stores. Despite the good intentions of the bill and the support from the PA House, the legislation languished in a PA Senate sub-committee for many months after its passage by the House. Let’s review some case-specific Pennsylvania toy recall matters. In January 2009, Pennsylvania won more than half a million dollars in damages from Fisher Price/Mattel for dangers associated with toys coated with lead paint. Other recent toy recalls include Mood Necklaces sold out of Rhode Island, "Elite Operations Toys" sold at Toys R Us outlets in nearby New Jersey, H&M Boys Jackets, Cobmex Drawstring Jackets, and child stationary sets. Rationales for these dangerous toy recalls have ranged from lead paint dangers to choking hazards to laceration hazards. Just because a Pennsylvania consumer group has identified a defect or regulatory non-compliance issue doesn’t mean that a particular toy is dangerous for your child. Sure, toys with sharp points or rough edges may not be safe for kids below a certain age, for instance. But if your child is above that cut-off age, the toys are likely to be safe for him or her. Along these lines, just because a toy or child product has been deemed "unsafe" or "defective" doesn’t mean that you should throw it away. In some cases, the manufacturer may provide -- free of charge -- repair kits or replacement parts to handle safety issues. For instance, a child seat manufactured in PA by the Peg Perego Company was recently revealed to have a sharp molding.
